I am never one to voluntarily give a tenant anything that is not necessary or costs me out of pocket but it appears as though you have serious management issues that put your tenant in the drivers seat.

In short, the process is:Buyer and seller execute a purchase and sale agreement (P&S)The P&S is sent to the closing attorney, who then opens escrow.Attorney requests and reviews title info and clears any defects.Buyer pays earnest money (if any) and closing funds into escrow account in advance of closing.Attorney prepares necessary closing documents and manages closing, delivering clear title to buyer and sale proceeds to seller from escrow account.Attorney closes escrow.

I would also make sure the seller is responsible for the inspector's second trip charge (if any).And yes, I agree with unit delivered vacant or $5000 WITHHELD IN ESCROW until tenant legally vacates after closing.
