So if your going to be doing this on the west coast be sure to ask the title co. before hand how the cancellation policy is handled. and or have it stipulated in the contract that the EM is to be released back to you within 30 days of mutual acceptance and make sure that will fly.Its one the reasons our closing are different here.

I rented an apartment in 2007 for a few months before I went to Iraq for the first time and the apartment neglected to inform me of these stipulations until I had broken the lease to deploy and ended up keeping part of my deposit or last month's rent (can't remember which) to make up for the difference.

Perhaps you can bend a little more, but draw up a contract with stipulations stating that you can front him a portion of his money through the $750, but it will be deducted from the final amount owed once closing is complete.

The IC agreement agents sign with a brokerage usually stipulate the listings and buyers etc. belong to the brokerage if the agent leaves.No legal advice.
