It doesn't sound to me as though you have any DAMAGES, and you if you're planning on suing the INDIVIDUAL it is likely a WASTE OF TIME and MONEY.Over 95% of all judgements against individuals in the US are WORTHLESS.

Unless you are talking about states that do judiciary foreclosures where the lender can seek a judgement against the homeowner for the negative balance, the seller is in no way affected by me negotiating a lower price in a short sale situation.
