I signed a ton of documents telling me about this when I did my loans back in nov/dec and every single email from title company had it in their signature as a warning.Also, it's absurdly easy to fake an email and make it look exactly how you need it to.

I have had some servicers accept a signed/dated letter from the homeowner declining the modification and I have also had some who force the 3 month trial to go by without any modified payments received THEN they’ll go into short sale.

I would assume at some point between signing the contract and closing a home inspection is done but I couldn't find out who pays for it and when it takes place.
