Additionally, every loan document now carries a clause stating that any additional loans secured on the property without the permission of the lender is an item of default, so if your loan document contains this language and the private investor loan is filed against the property you will have a first loan in technical default.If neither of these situations above are correct in your case, then having the title company, or closing attorney handle it all should provide the easiest solution.
