Once I checked with my lawyer and responded him that I will consider my options if he pays the rent, the deposit problem vanishes and I see this months rent in my account.I send a "rent with reservation letter" to the tenant and he acts confused and does not understand why he received that letter. when he spoke to my attorney, he is advised to show proof that he is really going out of country and the lawyer is asking me to consider postponing his eviction for practicable reasons if it turns out that the guy is genuine.I highly doubt that this guy is genuine as he has summons all over the country where ever he lived.

Unless you have a cash offer contract, with a legit POF, and no inspection/other contingencies, the bank is unlikely to postpone the auction for the hopes of your short sale going thru.

Two possibilities for a delay, one if the bank agrees, and two if the bank doesn't agree to an extension then you need a motion filed with the foreclosure court, a hearing,  and a postponement ordered by the judge.

I know I will likely have a new set of headaches in 4 months but at least I postpone those headaches until the winter months have passed.What do you think, should I take the high rent and let them live with just 100 sq ft per person, should I go through with the eviction or are there other legal ramifications that I should be concerned about?
