Given that I'm not trying to skirt the law here, to make it clear, I right now and for the foreseeable future intend to occupy ONE of the units in my three flat.

The tenant has an uncertain future in your property and understandably wants to move.

So if we act in a manner that gives one client constructive receipt then everyone of our clients past and future are at risk for being in constructive receipt of their funds. 

I also want him to feel like he has some stake in the company and offer some assurance that I'm not going to yank the rug out from underneath him if we disagree on something in the future. 

I am currently working on buying my first Commercial Property, considering a multi tenent retail plazas and small industrial buildings in Rochester NY right now. in the future I want to also invest in the Vero Beach area of FL. 

Plus in my personal opinion it is way too saturated and there will be less demand for rent in the future due to the massive supply. 

When my brother goes to qualify for another mortgage in the future, will the lender have any issue with him reporting the rental income even though he's not on the loan or has title to the property?

This way, you do not have to marry (which is equity/LLC) before you date (set return).In the future, after this deal, if you guys work together seamlessly, then maybe create a new LLC.
