My understanding is in January, unless things change, tenants can start being evicted for no rent paid, banks can foreclose for no mortgage paid, and mortgage payments will go up for those who skipped mortgage payments but did not think to still contribute to their escrow account for property taxes.

But if a tenant wants to leave, they are going to leave regardless of when the lease is up, and unless they have a fantastic credit history they are trying to preserve, you can sue them for damages but have a hard time collecting (especially if they skip out and now you have to try and locate them to even serve them and get your day in court).Back to your situation: I think you can file for eviction, but if the tenant shows up with the $25 late fee (or whatever it is), she cures the breach and she gets to stay until her lease ends.

@Basit Siddiqi We got lucky and sold our multifamily property right before covid and before tenants were allowed to skip out on rent.We then sold our coop as it was going to be cash flow negative (it was a studio in Manhattan which we had lived in for a few years).I did listen to that recent episode and it's one of the reasons I decided to post and get more involved in the BP forums.
