If there is a harassment situation, you can put documentation together and get a restraining order, THEN you can work with the landlord to potentially get him removed.

It seems to me like the fact that the landlord returned the security deposit could hurt their chances in court (which is always kind of a crap shoot)-- BUT the courts will probably view very, very dimly a tenant that falsified military orders which is the only codified reason an Ohio landlord is required to let a tenant off the hook for the breach of a lease term for a habitable unit (assuming no harassment or privacy violations by the landlord).

Failure to do so then automatically incurs a "late" fee as allowed by local LL/Tenant laws.Also, calling/texting multiple tenants, multiple times can very easily be seen as harassment, and is not appropriate.

You DO NOT want to end up with the current tenant still there in August with potential harassment or discrimination complaints against you AND the incoming August tenant suing you for non-performance AND the cost of alternative lodging.You do not state where you are located, so you need to determine local law and what the cost will be for an eviction, and how long they take.
