It's a delicate balance I suppose.  

The transaction will likely be considered lender fraud, especially if you are fabricating the sale just to make it look like a sale for lender purposes. 

Doing commercial loans gave me opportunities in other business ventures in other industries, food, hospitality/recreation, steel fabrication and automotive to mention a few.

I was delicate before- struggled hard to get me and my credit to where I could begin doing something, and now feel like some giant money vampire has decided to feed on me. i can't do this any more. i have a wife with no kidneys and on home hemo dialysis 5-6 days per week 6-8 hours per treatment, and getting unwanted pay cuts is no way for a 54 year old to live.

Their argument is simply that it corrodes the 'neighborhood fabric' of the area.

Because dealing with probate is such a delicate matter, when reaching out to the representatives, I would try to approach of 'how can I be of assistance to you in this difficult time' rather than, "I heard John died; I'd  like to buy the house' . 

Look at the economic factors that drive this and see if its external fabrication.
