That is so that you can compute ARV of the re-sale "more generously".Now, if you are trying to justify lower priced offers, then you would want to help your position by using similar condition comps; so, in this case you'd stick to cash purchases that were also REO or otherwise distressed.

(even if the statute says "reasonable attorneys fees") My understanding is that if the attorney that is charging them, feels they are reasonable, then he can charge them.In my situation, I have come across this 1 time too many with this law firm, it is so outrageous on what they charge in comparison for services that were done. ie, NOTHING but answering a motion on behalf of the HOA.

The biggest difference I have seen is that it is so much easier to rent than it was 1.5 to 2 years ago.

In order to avoid the costs to present proper documentation in order to foreclose, they are offering the borrowers and tenants cash for keys in order to avoid further damage and vandalism.A broker friend of mine actually witnessed a used car being given to a borrower in exchange for leaving the home in good condition and the keys.Since there is so much controversy over the foreclosure proceedures coupled with the sheer number of pending actions this is the best way around it for the investor.
