I still have not made any deposits and the contract I signed says the following"If Buyer determines, in Buyer's sole discretion, thatthe lease(s) or terms of occupancy are not acceptable to Buyer, Buyer may terminate this Contract by delivery of written notice of such election to Seller within 5 days after receipt of the above items from Seller, and Buyer shall be refunded the Deposit thereby releasing Buyer and Seller from all further obligations under this Contract."

If this one doesn't address it, the next one needs to have language to cover this scenario.If it isn't in there, they are obligated to pay rent for the duration, but you are obligated to mitigate the damages by marketing and attempting to release the apartment.

Reasons.. .. with that being said short version is you have think of a partnership as a whole body, each partner carrying their set weight. once your partnership is whole you can do more, but if any part of that body is weak then the partnership deteriorates, finding the right partners is hard. but worth it, keep meeting new people, and protect your interests with legal documentation
