These are still valid arrangements.The quoted part above is in reference to a contract for deed, not a Sub-2.Not speaking of politics as an opinion of one side or another, but your local political flavor absolutely influences the way the bench leans in any area, meaning that in very pro business areas that favor landlords for example, a deed in lieu of foreclosure will be looked upon through those glasses.

There's not any mention of appraised values vs sales price in the laws, with the exception of requiring your valuation models be disclosed to your buyer if your loan hits certain requirements.

This is no exception for insuring a garage that's about to fall down:) If you cant make it work, use the financing contingency where bank underwriting rejects loan without an insurable property and get out of the contract.
