You can always negotiate with the failed investor to see if they will quit-claim the property back to you or give you a warranty deed (preferred) in lieu of litigation, a.k.a.

Pl go the the civil court website and check for family or probate files. 

Ask OJ, he bought a multimillion dollar mansion in Fl before he could lose everything in a Cali civil lawsuit. 

In Louisiana one of the waivers that most landlords put in their leases is as follows:"Lessee hereby waives written notice to vacate the premises and/or delivery thereof otherewise required under Article 4701 and 4731 of the Louisiana Code of Civil procedures and article 2713 of Louisiana Civil Code.

Then the tenant sued them in civil court and that is still going on.

According to our company civil engineers and architects, new constructions can have LEED features built in to achieve energy reduction and recycled material. 

I mean they are offering the note at 3k or 4k.. even if they found out what are the damages.... no one is going to litigate over this stuff.Just like when I buy foreclosures if the house is empty I find a way in..
