@Justin Harper, if there is an HOA, or restrictive covenant, preventing renting the property, then you could run into issues. 

If so, does that prevent me from declining to renew a month to month lease? 

Posting a general comment for anyone following this post with a bit of information I have learned:By utilizing an SBA backed loan product you prevent yourself from setting amortization terms for seller financing for anything less than what the SBA offers.

An eviction could prevent the tenant from ever getting quality housing in my market (we accept no one who has ever been evicted).  

While having a signed lease wouldn't have prevented this, it may be good practice in the future to get all documentation signed before move-in and ensure that the prospective tenants are familiar with all of your rules. 

The key is to not let your fears prevent you from doing anything.
