If I were you, I'd have my attorney serve a 3-day against the former owner and "all occupants in possession", then file the unlawful detainer on day 4.

In my location, if you have terminated the tenancy and the tenant failed to move out, you have the right to file an unlawful detainer (eviction).

Keep the deposit, tell them to go and if they want to fight it I would give them 3-day demand to move and then file a forcible detainer immediately.
