( since he is very smart, liar and good in playing these games, I want to be on safer side) please suggest  What else you can do is to give them the late notice on the first day you can--BOTH of them.

I used to mistakenly believe that once a foreclosure sale is scheduled, the only way to stop it and save their equity was a cash sale, but lately I have seen several in my county be solved more "creatively."

I personally would spend an afternoon and reach out to different local lenders (banks and credit unions) and see what they will offer for a HELOC or possibly refinance the existing loan if your rate is high.
