The Sellers' Disclosure is the seller's responsibility, but if the listing agent sees a disclosable condition that's not on the SDN, he/she should advise the seller to add it, or refuse to work with the seller if he/she refuses to do so.

My accountant advised that I pay the taxes now and skip the 1031 exchange because taxes will most likely be higher in the future and will almost certainly not be lower.
