I would still ask what they need you for as they are providing every piece of the puzzle?

I've had broken windows, paint, and plumbing items flagged for repair but never stairs; although I have seen some really poorly constructed staircases and it's not terribly surprising to me that something like that could get flagged.Ultimately It's negotiable with the seller, although you should come to terms with the fact that you're an FHA buyer, and the seller would not have this issue with a conventional buyer; it entirely depends on your circumstances whether this is actually something the seller should pay for or not. 

I know they have a 10% preferred return, but what is the actual average return they pay?  

Point is, if you're an agent and you're actually bringing value to a transaction, none of this matters. 

., I would look long and hard at the actual return potential available in your current portfolio, as is, and what happens if you do sell and buy this 4 family.

I would not get too caught up in creating an LLC -  do that we you actually have a steady pipeline of business.
