Well since the judge did not want to drive in the snow, he was not presant- they said he was 'sick' (he showed zero signs of illness). 

You've forgotten more than I''ll ever know about this business and I'm not trying to be disrespectful in any way but your comment from yesterday seems like you're hoping to hear they didn't come through and ignore @Paula Wallace repeated success with this company.

Perhaps they will leave peaceably when you post the notice, but even if they don't, you're very fortunately in Texas where they don't go out of their way to make evictions more painful for homeowners.I would also file the lawsuit against the former owner, who is either mentally ill (did they "forget" they sold the place?)

Does the tenant care that I have to pay the mortgage/taxes/insurance, regardless of a job loss, illness, etc.?
