Your attorney can advise you about naming the new owner as an additional defendant, among other things.I assume if you finished the foreclosure, and you got title at the auction, the title would be your name, not the borrower’s name.Are you sure the 1st mtg didn’t foreclose?

Either process could work, but if he is securing his interest with a lien on the property you are purchasing, then he should most likely send the money directly to the title company (and have you sign a note and mortgage or deed of trust).
