It sounds like you can demonstrate that she did have the intent to hold for rental/investment purposes but that the CC&R and/or HOA rules do not permit the rental of the unit, which you can easily prove to an auditor.

The city of Naples doesn't have a minimum sq ft requirement so they were able to get the permit and do it.I think that it would be cool to build one and then rent out during high season.

Like above, what government authorities do I need to work with, where would I go to apply for permits, etc.
