A tenant says "xyz" (sewer gas, mold, peeling paint, etc.) is making the property uninhabitable and a health or safety issue, so they are not paying rent, or pay whatever they feel like.Question we always ask in court: "If you feel the property is uninhabitable, why are you still occupying it?"
