If some cause of action were to arise, the exposed party to litigation would be the legal title owner (in this case the LLC) and, yes, attorneys would also name the principal or managing members in the lawsuit.

When Subject To gets under scrutiny, the Subject To buyer had better have his facts and evidence in order and a nice reserve bank account and someone who knows their stuff with them.Cases like that can be brought even 6 years after the original contract (for most bank fraud crimes the SOL is 10 years), court can run a year and a half to litigate and cost $25,000 to $50,000 just in legal fees.

Funds are a bit limited right now- I have a chunk of money currently tied up in litigation (not real estate related and I can't really go into any details) so I was trying to wait until that was finished but it's taking longer than I expected so I'm looking to see if I can get something going in the meantime.
