My wife and I were working with a realtor who found the deal, but it was her first transaction and totally botched the whole thing, won't go in to details but at the end of the day she didn't want anything to do with it but still wanted her commission.

Dropping property out of a limited liability company that is treated as a partnership for income tax purposes and then immediately selling and structuring a 1031 Exchange transaction will create risk since the individuals never acquired the title with the intent to hold for rental or investment purposes.

If you'd like to see what we used, msg me your email and I'll send it along.Some things to consider are not paying until moved out and all keys returned, stating that the property must not be damaged or otherwise change overall condition between signing and vacancy, property must be "broom clean", all possessions left behind are forfeit and will not be held, all tenants regardless of whether they are on the lease must vacate including pets and animals.
