Now the property owner intends to develop some new homes and is realizing if they go rip up the improvements they could force the prescriptive easement claim.My advise would be to get your survey now (even if it does cost several thousand), and remove the encroachments or make them yours i.e. take ownership and maintain them....erect a new fence to create a boundary that shows your vs. her property something.

The Party of the First Part hereby grants to Party of the Second Part, their heirs, and assigns, a Driveway EASEMENT and Right of Way, together with the full and free right at all times hereafter, with automobile, or other vehicle, or on foot, for the purposes of ingress and egress to and from any portion of lot 14 hereafter designated to pass and repass along and a strip of land approximately 5 feet wide extending along and upon the south line of lot 13.It is further understood and agreed that the Easement granted herein is to be held by the respective grantees, their heirs, and assigns, as appurtenant to the land owned by the grantees.It is further understood and agreed that the Party of the First Part will and does agree to pay one-half and the Party of the Second Part will and does agree to pay one-half the cost of maintaining the present paved driveway over the respective easement herein granted, together with cement approach and sidewalks which now form a part of said driveway and over which same extends.This agreement has been executed in duplicate by the parties and each executed copy thereof shall be considered an original.
