While real estate agents (buyer's agent) can negotiate exclusivity on a deal-by-deal basis, I cannot imagine an investor signing an exclusivity for multiple properties or a market.

If this deal was financed, under RESPA rules, I believe it would technically be illegal for you to pay the title company anything related to this transaction outside of what was on the HUD-1.Of course, I can't imagine anyone having an issue with $40 changing hands, but it's still weird.
