So basically we are where we were before 199A, with sifting through the grey matter when trying to define a trade or business under 162 which doesn't define it clearly itself... but per the Supreme Court in Groetzinger, 480 U.S. 23, 35 (1987), said, “We accept the fact that to be engaged in a trade or business, the taxpayer must be involved in the activity with continuity and regularity and that the taxpayer’s primary purpose for engaging in the activity must be for income or profit.”

You do have to do it but the Ohio Supreme court struct down the ruling that you need to have it done in order to evict so that is no longer a requirement.

That said, I would probably recommend the CAR forms simply because (1) every item on the form is probably there as a result of some litigation, and therefore to use a form that doesn't have those clauses is subjecting yourself to risk  (2) the CAR forms are battle tested, and they hold up to the California supreme court  (3) it is a fair contract that protects both buyers and sellers.
