Sounds like there might be documentation saying that it is grandfathered, however that still wouldn't allow a rebuild if the structure is damaged by more than 50% of the value unless your city has different rules relating to when a nonconformity expires.

I suggest you forget the MLS and start dealing with FSBO's and Expired Lists, sending direct mail out for real estate wanted, advertise for real estate wanted.

I think  you need to be sure that they are legally Month-To-Month tenants by whatever laws your state allows when a lease term expires
