Our thinking is to either foreclose and sell the REO to investors, or just sell the distressed, pre forclosure note so the investor can "be the bank" and foreclose.

You should not get any tax stamp as there is no change of control if you still own the LLC.The section 121 exclusion will only work if you sell the property to a different taxpayer.

At this point, I see only 3 options1) assign the contract to someone else, meaning sell the apartment (but I will need approval from the developer)2) talk to the developer and ask for a minimum one-week rental (Min City Regulation) at least for the 1st year to get over the bad time.3) to just go ahead and purchase the apartment and suck up any loss I might make and try to get in refinanced as soon as possible with a lower interest rate.What are your thoughts?

I ran the new listing with my own photos (pro) as they wouldn't sell the previous set to me and blocked off the calendar so it didn't interfere with their bookings and my calendar only opened after our date of separation.

Delays to finish construction and to place tenants.I was able to sell 2 properties back, even though got paid way less than what they sold them for but my last property I simply do not know what's going on since April, when the 12 months guarantee rentals period finished.
