We are repairing rotting, moldy floor joists, a condition that extends through the floors of the other unit, due to years of leaks and neglected maintenance by the previous owner.I have explained to my tenant that the unit is not suitable for habitation because of the mold and rot, and that these issues cannot be repaired on her side while it's occupied.

Regardless, depending on the police departments sophistication, they will examine everything inch of the unit before release it back to you/tenant.

Keep in mind everything in the exclusive contract is negotiable so one approach might be to sign a 3 month agreement to test the waters and see how it goes, if you find your getting good service and work well with the agent you can always extend / resign. regardless of any exclusive agency agreement you are free to search for properties yourself, the advantage of using an exclusive agent is that if you find a property (driving, online etc.) you can send the address to your agent and they will layer on their advice / recommendations / thoughts on the property as it relates to the market.

Basically the five year look-back period just gets extended by the length of your deployment.If you didn't move back in after your military move, however, you still don't meet the test, sorry.Since you mention 1031, I assume you rented the property out during your time away?
