Don't leave that sort of thing up to the tenant, a mistake is too costly.

(There are several closets in the basement that can additionally be used for storage already)I am sure there are some liability issues and I would need to make all tenants sign a release of some sort.

When you're actually getting ready to submit a LOI, sort out the details.

Doing that repeatedly is sort-of, kind-of, but not really abusing the intent of the program to help owner occupant buyers, not real estate investors. 

The Housing for Older Persons Act of 1995 (HOPA) seems to specifically permit this sort of rental.
