Issues with a private lender

MY situation is this: I own a single family rental that I want to refi or perhaps sell. The lender is a local private individual who has helped finance several deals for me over the years. There is a substantial discrepancy in what he claims is owed and what I claim is owed. I want to resolve the matter now rather than waiting to do it in escrow or after receiving an offer. My question is this: upon my request is he required to give me some sort of statement of compliance or other accounting of payments? If he is required to do so, is there a protocol I must follow to make the request. Thank you for any assistance you can provide.
