If the court orders the disposition as I mentioned and say the bankruptcy continues with other matters and is discharged 30, 60 or 90 days later, I doubt the borrower will be showing his face as he would be in violation of a court order.

Can a bank reap the benefits of the disposition of collateral property writing off the mark down, reducing reserves for bad debts and avoid further losses by allowing a property to be sold at a value less than par value of the note?

The yes/no decision is not theirs to make and if the agent draggs out the disposition of the REO, it could hurt their relationship with the bank/AM.So if it has been on the market awhile, the agent should be eager to get rid of it.

Same with trusts, but I have found that there is usually no hurry if the property was held in trust and the trustee does so much property dispositions that they call their agent or auctioneer.Is it profitable, yes it can be if you are lucky to get in the loop and are skilfull in dealing in distressed situations, willing to put up with all kinds of problems that may surround the estate, like mortgagees and claims/encumbrances.I have had a few good deals, but I think I earned it too!
