If it's described in the note it's part of the financing agreement.I'm not yelling, I just don't have the tricks to show emphasis :)Also wrong as to definitions of private money, it is described by reference in federal law as exemptions to regulatory compliance matters, private sources being known persons that you have had a business relationship (SEC matters) immediate family, partners in a business arrangement, (SEC, various regulations and tax code).Additionally, definitions lead us to who is not a private lender, those who are consider by tax law that are in the business of lending, mortgage and loan brokerage laws omit private party transactions and require registration of those in the business or deal in certain types of brokerage or lending activities.
