We referred them to an attorney who finally got them out and we have re-rented one (other one still in progress) Funny though, tenant wanted a stipulated judgment with the attorney and said she would pay x,y,z on dates (which they agreed to) but obviously never did.

Correct, not all hard-money lenders require bank-statements.Further, John, it may not be considered a cash-out if your loan was X, you put in Y and the total cost was Z to get it to be a rental.
