Recently a unit owner noticed no one was parking in a space and it was discovered that this one space was never designated or conveyed in the declaration etc, and no deed for any unit in the building lists this parking spot.

We've got another situation ongoing where we actually had a first position lien, sued for damages, were awarded a FIFA lien against the owner, foreclosed, owner declared bankruptcy, and we're still going after it... almost 3 years of litigation and 5 figures in lawyer fees to get paid from one job.So, in conclusion... perform->pay doesn't hold much interest for me.

I have seen this go to court and the judge declare this agreement to be a Land Contract and not a lease option, if part of the rent is credited towards the purchase.

Add the fact that the Property Code declares open season on the investor/seller whenever a tenant/buyer becomes disgruntled with an executory contract, and there are more reasons to avoid lease-purchases than there are to do them—especially since loss of an executory contract lawsuit could present an extinction event for a small investor.
