So I guess my question is how much or should i even let them do this, they were a great tenant when there paid rent on time and early, then they hit hard times and couldn't afford the unit they were at any more.

Now that the lease is over and I deducted the cost of these repairs he is fighting it in court saying I already paid for it. 

The best solution in your situation would be to get a non-owner occupied loan with no pre-payment penalties to buy the building then cashout refi in September when you move.

Are mortgage points paid on a rental property deductible the year the property was purchased, or do they have to be depreciated over the life of the loan?

Is the remaining 2/5 of the total paid toward discount points a deductible expense at that point, or will that portion never be deductible?
