Not under any concrete, per say.A good, graded, perforated perimeter drain pipe, dug down around the problem area, in addition to your sump pump, should do the trick.The real question, I would think, as far as legality goes, is will your tenant make a false claim of damage to his personal property, just to get you to fix it.I would encourage you to get a professional out there and just bite the bullet. 5 years from now I think you will be way happier you did.

The more likely outcome is they will eventually have to be evicted or encouraged to leave with an offer of their full deposit and maybe more cash.
