Since I'm assuming that's the case, I'm planning on waiting until the end of the month and giving him notice before December 1st in the hopes I can work with him to collect rent for November, because based on the way things are going, I'm highly doubtful I'm going to see rent checks for December and January.So, my main question is, if it gets to January 31, and he's still in possession of the unit, do I have to file for eviction or can I go straight to the police to enforce this?

I've found @Elizabeth Wilson 's approach works a high percentage of the time.Create a document (2 copies), Surrender of Occupancy, note date, time, amount given and the statement:I am surrendering possession of the unit at ________________ on this date and have surrendered the keys for the amount noted above.both parties sign and exchange one copy

I should be able to have the place cleaned up by this weekend.While I was at the courthouse filing for an emergency possession hearing because they weren't letting me in to fix a leaky sink they said was leaking on an electrical box (I checked--it isn't), they dropped their keys in my mailbox.
