@Francene Iaizzo, since this is pre-contract, you might consider having the standard language  making the closing subject to clear title.

Here's the language from the actual code:(a) A person who sells goods or services commits an offense if:(1) the person advertises or promises to provide the good or service and to pay:(A) all or part of any applicable insurance deductible;  or(B) a rebate in an amount equal to all or part of any applicable insurance deductible;The quote you post, which is not sourced, seems to just be pointing to a loophole where a roofing company "does not seek payment" for the deductible.
