I think they key is to be truthful though - in these cases (at least with FSBOs) you're going to be one of the lower offers and it helps them to adjust to that idea a bit better than a BAM IN YOUR FACE low ball offer out of the blue.

I am unclear on who this would work if its sold above UPB.. would the owner of the home simply get a check out of the blue for the overage at the time the note is sold.. then the owner like you said refi's and pays off what is owed.. and the buyer of the note is out this over payment ???
