I will say that anyone who is speculating for appreciation with non-cash flowing properties and is using leverage to do it is headed for disaster unless they have extraordinary timing.

If you can't show how the deal makes sense before you do it, don't do the deal.If your P&L is based on speculation or wishful thinking, don't do the deal.If you don't have multiple exit strategies, don't do the deal.However, if the only way you are going to be willing to invest is when you have guaranteed returns, then I think you're in the wrong business.

Title coverage generally covers only surface rights as these are reasonably measurable financial losses that can be valued, we can only speculate if gold, or silver, copper, oil, natural gas or diamonds exist 5 miles up from the center of the earth and title coverage can only insure known assumable valuations, not to speculative values.

We can speculate or give suggestions, but we can't really answer the question because we don't know how the parties operate.The law requires them to fulfill the terms of the lease until a new Tenant takes over.
