Of course the agent can reject the clause but then you don't have to work with that agent :)

I would put in an offer and he would tell me that it was rejected.

Update:Unfortunately the sellers rejected our offer of $22.2K which was 7K over the listing.

The mortgage broker (Frank Acevedo, Prime Lending) that we're using said that the bank may reject it since it's an investment property if there's currently a tenant.My Realtor says normally the seller just buys out the tenant's lease.We're going to look at Monday and see if it's actually something we'd want haha.

Have read many horror stories online about FannieMae either rejecting your offer (even if full price) and then re-listing the property with a price reduction or at the same price.
