If we weren't positive we were going to buy the property (assuming no issues on the seller side, that is), we probably wouldn't have done this, but we've never not purchased a property that we had under contract (again, other than due to seller issues), so I'm not concerned.Btw, with this particular house, we found the roof leak to be extensive, and for the first time, we'll actually be asking the seller's permission to do repairs before the closing; we'll see how that goes

If for some odd reason they do still want to complete the short-sale, their attorney will have to get permission from the court and the trustee to sell their (negative) interest - its fairly easy for them to do, but they don't really have any motivation to do so - and an attorney may advise them not to do a short, simply because nothing good can come to them from it.

Regardless of whether it is a simple code violation, damage etc. you are not to lift a finger to improve or repair a HUD house until you own it and your name is on the title.I got permission from the HUD Field Manager in my area to turn on the utilities on a HUD home I was working on that I had under contract.

I don't give them permission outright, but I do avoid blindly throwing stuff over the rim if I see their truck still nearby.

So my solution was to market other wholesaler's properties with their permission, which would allow me to raise the capital to start marketing and eventually have my own properties under contract.

This results because the property does have to be managed by an independent 3rd party and it is permissible to self manage the properties. so instead of hiring a third-party management company you simply hire your spouse to manage the property.
