@Kenneth LeBeau,In most counties (except several California counties) title can submit both Deeds to be recorded in the priority they indicate to the recorder (your purchase first and your resale right behind it).You can always execute documents before an actual legal closing and transfer of title takes place.

As far as your tenant goes, the lease that you have in place would be of force even if the property were foreclosed so if you wanted to protect the tenant you could execute a longer lease (say 24 months) to make sure that they were not at risk of eviction as long as they paid their rent on time.
