Professional Tenants From Hell
Hello everyone!
A friend of mine recommended that I reach out to you all for your knowledge and expertise. My family is in dire stress.
Over three years ago, my family rented a private house to a man, who brought with him three women: his cousin, his sister, and her daughter. After about three months the cousin left the residence, but the man and his "sister" and "niece" remained. After a year, he struggled with his rent but made arrangments to pay his back rent, even signing notarized documents admitting he owed money and would pay it off.
In the second year, he paid his rent and gave money towards his back rent and it was OK. He never once complained about anything. In October 2015, we gave him notice to leave, citing we needed the house for a family member. He and his "sister and niece" agreed to all move from the premises. In November, however, he revealed he needed more time — until the end of December — and since he was able to pay for both months, my family allowed it. In December, however, things changed.
He didn't leave at the end of December. In January, he gave partial rent saying he'd leave in the middle of the month but didn't. When my mom hired an attorney, we were told the partial payment hampered her from starting an eviction and we'd have to wait until March.
He was finally served in March 2016 and unfortunately given a court date at the end of April. He was told to leave by May 13 or pay rent. He did neither. The lawyer also made a huge mistake by not immediately ordering a warrant of eviction, thinking the tenant would actually leave. At the end of May, the warrant came, but before it could be executed, the tenant called the court for a show cause.
Thankfully, the judge sided with my family and told the tenant he and all his people needed to leave "with dignity," but when the second warrant came, another headache would ensue.
His "sister and niece" weren't sister and niece at all and while we thought she was a girlfriend, she claimed to be a subletter — and made it clear she knew she couldn't be evicted on his warrant after lawyer attempted to the amend the eviction. She even took my mother to court with several "receipts" saying she paid rent!
The original tenant left before he could be tossed out (never returning his keys at that), but the woman took my mom to court again demanding she stay until July 31 because she was "buying a house" and her daughter was "making a movie." Unfortunately, the judge told her she could stay but would have to leave by the 31. She told the court she had a place to go if need be.
This time, my mom got the warrant herself and by the beginning of August, there was a warrant in place. Before it could be executed, the woman's daughter called the court for a show cause. Again, my mother went to court but neither mother nor daughter showed and the court ruled in favor of my family. My mother even got the judge to sign off that there could be no further extensions.
The marshall told my mother he would execute the warrant the very next day, but and hour before he arrived, the woman had called the court to show cause — and they gave her a court date. When we called the court to ask HOW this could happen, they told us they can't deny a person from calling to show cause, even if one judge said no extensions could be made.
Making things worse, the marshall told my mother it was his last day before vacation and if any order of eviction came in, it would have to wait until he came back to be executed.
At this point, my mother's health has in shambles due to stress and all the lawyers say to us is "they'll get out eventually." Does anyone know of ANYTHING we could do to get these people out?

The attorney you hired is not a good one !! Always hire an attorney who is experienced in evictions and knows state and local laws and court rules/protocol.
