If rent is due on the first, it's late on the second and the landlord should begin the process of eviction THEN, typically by providing what is known as a Pay Or Quit notice giving the tenant a certain amount of time to remedy the situation. 

I would cut the tree down and that would be the end of it, but if the leak continues, we would possibly have to deal with the flooring which looks like Asbestos tiles, according to the inspector, which I know myself would be expensive to remediate.
