If they cannot move the home then you get a Writ of Possession for the lot.  

Even at this, a discount would not be guaranteed, but it is likely in view of other costs and expenses of foreclosing and taking possession of the property.

If, after a certain period of time that person does not move, you can go back to court and take possession of their home through abandoned property laws.  

I was told by the particular sales agent I worked with that I ask too many and too detailed questions and that it is ok to enter into contract with a known misstatement of certain facts on my behalf (such as possession of title, etc.) as I am doing so in good faith… This is unusual and certainly not consistent with prior business transactions I have experienced.

The lender on your new build would run a title search and demand that the previous lien be cured (paid off) before they would lend you the money for the new build on that parcel... otherwise the old loan could take possession of the new buildings on the property, which your new lender would not allow. 

And the check to the seller is going to be less than the down payment because they have costs, too.The contract you and the seller write will specify when you get possession.  

I agree with you .What I am saying is a  GREAT real estate agent needs no education to be good. they need innate sales skills.I have owned 3 real estate companies and had 200 agents come through the door over the years.. many very educated but simply could not sell a lick  .. they did not possess those certain skills that are needed...

I haven't dealt with your situation but I'd imagine Spartan would at least see everything through until the keys are handed over and you've confirmed possession of the property.

And read it for all dates allowed and needed.I would personally go over the fees that you are due with him at the time of signing the non-renewal notice, and have a separate form that says you are waiving all rights to collect those (the deposit since you are rehabbing anyway, and the last month's rent) in exchange for possession of the property on _____ date).
