'We Buy Houses' has been trademarked for a long time, and more recently they sold to a company that now claims to be enforcing the phrase under their trademark rights.It seems like a very generic phrase, so I am wondering if their trademark will actually hold up?

So, here's some homework for you if you want me to stop using front-loaded to describe the situation in question: come up with a better one or two word phrase that describes it and makes it smell like roses. 

They may have phrased the request weird, or the person you spoke to may have gotten crossed wires from the underwriter.
